Police were dispatched to a residence for the report of a Domestic Battery. The police officer arrived and spoke with the accuser who stated the following in summary:
She picked up her boyfriend, who is our client, from a work Christmas party. Our client had been drinking at the party. When they got back home, he became emotional and punched the wall several times. She claimed that our client then became upset with her and struck her with a closed fist above the left eye.
The police officer observed swelling above the accuser’s left eye.
The officer attempted to speak with our client, but he would not open the door for the police. The police said that our client was yelling at officers from inside the residence and crying.
The police arrested our client and charged him with Domestic Battery.
After carefully reviewing the police reports and information in the state’s discovery production, we took an aggressive position and advised our client to set this matter for trial.
Our trial attorneys prepared for trial. We diligently reviewed all of the evidence and prepared to aggressively cross examine any witnesses the state would call against our client.
On the day of trial, our team was prepared and ready to try the case. The prosecutors did not have sufficient evidence or the cooperation of necessary witnesses to proceed. The prosecutors motioned the judge for a continuance. Our team’s trial attorney successfully objected to the granting of any continuance.
