The police responded to a residence for a domestic disturbance. The caller advised 9-1-1 that his brother is drunk and causing problems and tried to hit their dad.
Upon arrival, the police knocked on the door and heard people yelling. The police could hear as someone was attempting to unlock the door but was unsuccessful. The police officer could hear a male voice yelling, at which time the officer asked if they need them to force entry into their apartment. The male shouted “yes, we’re holding him down”. The police then kicked in the door. Inside, two males were holding down an intoxicated subject. The police immediately placed him in handcuffs as he was continuously trying to get up.
The police officer spoke with the intoxicated male, who was our client. Our client was not cooperative in explaining the incident, only advising “ask them”. The police officer spoke with the brother who said that our client returned home drunk and got into an argument with him and their father. Our client approached the father and placed pushed him against the wall, and raised his right fist in the air. The brother apprehended our client, helping to hold him down prior to the police’s arrival.
The brother provided a written statement for the police.
The police officer was unable to gather a statement from our client due to an unwillingness to cooperate. The officer observed red skin on our client that would corroborate the brother’s summary. The police officer informed our client that he is under arrest for domestic battery and transported him to the police station for booking.
At the police station, our client was charged with domestic battery and transported to jail.
After carefully reviewing the police reports and information in the state’s discovery production, we took an aggressive position and advised our client to set this matter for trial.
Our trial attorneys prepared for trial. We diligently reviewed all of the evidence and prepared to aggressively cross examine any witnesses the state would call against our client.
On the day of trial, our team was prepared and ready to try the case.
The prosecutors did not have sufficient evidence or the cooperation of necessary witnesses to proceed. Had the prosecutors attempted to bring in evidence via hearsay or other means, our experience trial attorney was prepared and would have blocked such a move.
The prosecutors motioned the judge for a continuance.
Our team’s trial attorney successfully objected to the granting of any continuance.
