Client was charged with Domestic Battery for allegedly beating up his father. Our law firm was successful in getting All Charges Completely Dismissed.

The police responded to a house for a physical domestic between a father and son. On arrival, the father and son were separated and there were no reported weapons in the home. The fire department was also dispatched to the scene for injuries to both parties. 

The police officer located the father, the accuser, in the driveway to his home. The police officer spoke with the accuser who in summary advised the following: He has been having issues with his son for the past several years. His son has been having violent outbursts. The accuser advised that the police department were at his house on prior occasions for prior incidents. Since yesterday’s incident, his son has been slamming doors throughout the house and is not listening to him and his mother. 

Our client asked his mother to drive him to a store so he could buy something. The accuser told his son that his mother was not going to drive him and for him to walk. Our client became upset and told him he was going to kick his ass. The accuser then told his son to step outside if he wanted to fight. The mother then got in between the accuser and our client to keep them from fighting inside the living room area. Our client then reached over his mother’s shoulder and grabbed the accuser by his shirt and right shoulder. The accuser then pushed our client to the floor and they began to wrestle on the ground.

The police officer walked inside the home to speak our client. He located our client sitting on a couch in the living room. While in the living room, the police officer observed several drops of blood smeared on the carpet and drops of blood on the hardwood flooring in the dining room.

In summary, our client told the police officer the following:  Our client asked his mother to drive him to a store to buy something. His father interrupted the conversation he was having with his mother and was told that his mom was not going to drive him. His father then got in his face and told him, “Let’s go, let’s go!”, egging him on to fight. His mother then got in between our client and his father to keep them from fighting. His father then punched him in the face causing a red mark just below his left eye. Our client feared for his life and put him in a choke hold. Our client knocked his father to the ground and they began to wrestle.

The police officer observed a red mark to our client’s left cheek.  The fire department checked his injuries. 

The police officer walked outside the home and spoke with the mother in her driveway. She witnessed the incident and called the police. In summary, the mother advised the following. Her son asked her to take him to a store and his father told him no. Her husband and son began to argue in the living and she got in-between them to prevent them from fighting. Her husband and son antagonized each other and a fight broke out. The mother could not remember who threw the first punch and only recalled seeing them wrestling each other on the living room floor. The mother walked out of the living room and dialed 911. 

 

 

The mother provided the police with a voluntary written statement of the incident. 

 

The police decided to arrest our client.

 

After carefully reviewing the police reports and information in the state’s discovery production, we took an aggressive position and advised our client to set this matter for trial.

 

Our trial attorneys prepared for trial. We diligently reviewed all of the evidence and prepared to aggressively cross examine any witnesses the state would call against our client.

 

On the day of trial, our team was prepared and ready to try the case.

 

The prosecutors did not have sufficient evidence or the cooperation of necessary witnesses to proceed. Had the prosecutors attempted to bring in evidence via hearsay or other means, our experience trial attorney was prepared and would have blocked such a move.

The prosecutors motioned the judge for a continuance. Our team’s trial attorney successfully objected to the granting of any continuance.

 

The prosecutors then had no choice but the dismiss the case against our client.

 

Our law firm was successful in getting All Charges Completely Dismissed.

Who Prosecutes Domestic Violence Cases in Darien, Illinois?

There are two prosecuting agencies for offenses that occur in Darien. Darien DUI, traffic and ordinance violations are prosecuted by the City of Darien City Attorney.

All Darien Domestic Violence cases are prosecuted by the DuPage State’s Attorney’s Office.

Where Do Darien Domestic Violence Cases Go to Court?

All Darien Domestic Battery cases are heard in the DuPage County Courthouse: the Circuit Court for the 18th Judicial Circuit, located at 505 N. County Farm Rd., Wheaton, IL 60187

When a person is arrested, he or she is taken by the Darien Police Department to Courtroom 4016 for a bond hearing. The judge in courtroom 4016 sets bond conditions and gives the person an arraignment date in DuPage courtroom 4007.

All other proceedings on the case will be heard in DuPage courtroom 4007, which hears all DuPage County Domestic Violence cases.
